1. Definitions
Supplier / Importer: Importer of electric microcars within the European Union.
Buyer: any natural or legal person placing an order.
Vehicle: the electric microcar imported and supplied by the Supplier.
EU Directives: refers to applicable European regulations on product safety, consumer rights, and warranty.
2. Applicability
These Terms & Conditions apply to all quotations, orders, deliveries, and agreements between the Supplier and the Buyer, in accordance with relevant European regulations, including:
Directive 2011/83/EU on consumer rights (distance selling)
Directive 2001/95/EC on general product safety
Directive 2006/42/EC (Machinery Directive, for relevant components)
Directive 1999/44/EC & Directive (EU) 2019/771 on consumer sales and guarantees
3. Orders and Advance Payment
All orders require 100% advance payment.
The order is officially placed with the manufacturer once full payment has been received.
Changes after payment require written approval.
4. Pricing
Prices include import duties NL, customs clearance, and transport to the pickup location in Amsterdam, as well as applicable EU taxes known at the time of order.
Prices exclude any new tariffs or logistic surcharges introduced after the order date.
Optional accessories or services are priced separately.
5. Delivery Time & Transport
Estimated delivery time: approximately 10 weeks.
This timeframe is indicative and depends on manufacturer availability, shipping schedules, customs procedures, and external logistics conditions.
Transport Insurance (Optional)
Standard shipping from China is not insured unless specified.
The Buyer may request transport container insurance from China to Europe at an additional cost.
If the Buyer does not purchase transport insurance, the Supplier is not responsible for loss or damage occurring during overseas shipment.
In accordance with Directive 2011/83/EU, the Buyer will be informed if the agreed delivery time is exceeded by more than 30 days.
6. Pickup & Delivery
Standard pickup location: Amsterdam, the Netherlands.
Delivery to the Buyer’s location can be arranged for an additional fee.
The Buyer must inspect the Vehicle upon delivery for visible defects or damage.
7. Warranty
7.1. Statutory Warranty
Consumers are entitled to a minimum two-year legal warranty under EU law.
7.2. Commercial Warranty (Supplier)
2-year warranty on the Vehicle (excluding normal wear items)
1-year warranty on the lead acid battery
2-year warranty on the lithium battery
2-year warranty against internal corrosion
7.3. Exclusions
Warranty does not apply to:
wear-and-tear items
damage caused by misuse, accidents, water ingress, or overloading
third-party modifications or repairs
insufficient maintenance
failure to follow manufacturer instructions
8. Conformity & Product Safety
The Supplier ensures compliance with:
relevant CE marking and component safety requirements, where applicable
EU general product safety obligations
A Certificate of Conformity (CoC) is supplied when available.
9. Cancellation and Refunds
Once advance payment is made, orders cannot be cancelled, as every Vehicle is specifically imported for the Buyer.
Exceptions may be considered in writing and may involve deduction of costs.
The EU right of withdrawal may be excluded for:
custom-ordered or specifically imported Vehicles under Directive 2011/83/EU, Article 16.
10. Registration
The Buyer is responsible for:
registration with local authorities (e.g., RDW in the Netherlands),
insurance, compliance with national road regulations.
Assistance is available for an additional fee.
11. Liability
The Supplier is not liable for:
indirect or consequential damages, delays caused by customs or international shipping partners, damage resulting from improper use.
Liability is limited to the invoice amount, within the limits of EU law.
